Terms of Service

Effective Date: 16 February 2026

These Terms of Service (“Terms”) govern your access to and use of the BrainIAC Platform (“Platform”). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you may not access or use the Platform.

1. Research Use Only

The Platform is an experimental artificial intelligence research tool provided solely for non-clinical research and educational purposes.

The Platform:

• Is not a medical device.
• Has not been reviewed, cleared, or approved by the U.S. Food and Drug Administration (FDA) or any other regulatory authority.
• Is not intended for medical diagnosis, treatment, clinical decision-making, or patient management.
• Outputs generated by the Platform are experimental and must not be used to guide patient care.

2. License Grant

Subject to compliance with these Terms, the platform creator grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for non-commercial research and educational purposes.

This license does not permit:

• Clinical use or patient care applications
• Commercial deployment or monetization
• Use in regulatory submissions
• Reverse engineering, model extraction, or replication of underlying model weights
• Redistribution of model outputs for commercial purposes

All rights not expressly granted are reserved.

3. Prohibited Uses

You agree not to:

• Upload Protected Health Information (PHI) or personally identifiable information
• Use the Platform for clinical purposes
• Incorporate the Platform into commercial software or services
• Attempt to copy, extract, or replicate model weights
• Misrepresent the Platform as approved for medical or clinical use

You are solely responsible for ensuring that all uploaded data is fully de-identified and compliant with applicable laws.

4. Data Handling

• Uploaded MRI data is processed transiently for inference purposes and is not stored after processing is complete.
• The Platform does not retain uploaded imaging files.
• Limited usage analytics data may be collected through third-party analytics providers to improve platform functionality.

5. Disclaimer of Warranties

The Platform is provided on an “as is” and “as available” basis without warranties of any kind, express or implied.

The platform creator disclaims all warranties, including but not limited to accuracy, reliability, fitness for a particular purpose, and non-infringement.

6. Limitation of Liability

To the fullest extent permitted by law, the platform creator shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising from use of the Platform or reliance on its outputs.

Total liability, if any, shall not exceed USD $100.

7. Indemnification

You agree to indemnify and hold harmless the platform creator from and against any claims, damages, liabilities, losses, costs, or expenses (including reasonable attorneys’ fees) arising from:

• Your violation of these Terms
• Upload of identifiable or unlawful data
• Clinical use of outputs
• Misuse of the Platform

8. Governing Law

These Terms shall be governed by the laws of the Commonwealth of Massachusetts, United States, without regard to conflict of law principles.

Any disputes arising from these Terms shall be resolved exclusively in the courts located in Massachusetts.

9. Changes to These Terms

These Terms may be updated at any time. Continued use of the Platform after updates constitutes acceptance of the revised Terms.
